It has a sex, but its gender is non existant as that brain is still developing and gender isn't what sex organs you have, it's how you behave in relation to others. The snowboarder: IF that was in the US, yes. In most states you can threaten someone with a gun for being on private property. Provided you have posted signs warning people that tresspassers will be shot at regular intervals. This is not a free licence to kill, nor even shoot the gun at/near them. If you do that, it will go to court and you'll have to defend why you did. BUT it is NOT illegal to use a weapon to compel people to leave private property.

It's amusing how these show-offs spatter their writing with long and unusual words, in such a way that it's clear they don't actually know what they mean or how to spell them. I did my 11-plus way back in 1959 - old-style English test to try to decide whether you should go to an academic school or one more vocational, long abolished. Part of it was an IQ test. In the run-up we did lots of practice and learnt how to understand what the test wanted. Apparently I got 152, which is high. Now I know I am pretty intelligent at the academic level, but I think that score really meant that I had managed to learn how to do the sort of IQ tests we had been practising all year. I could have dressed this up with a lot of fancy words, but that's just a sign of insecurity.
